Stiff Resistance is a Human Right!: Malcolm X Grassroots Movement Statement on Mutulu Shakur

mutuluiswelomehere-graphicOn April 7, 2016 the US Federal Parole Board continued its blatant violation of the human rights of Dr. Mutulu Shakur by refusing to release him from federal captivity after 30 years of time served even though he is up for “mandatory parole release” based on the guidelines under which he was sentenced. While this is a major blow to our movement we are not surprised by the outcome. This refusal by the board to parole Dr. Shakur is evidence of the continuation of COINTELPRO low intensity warfare on the Black Freedom Movement and on our Freedom fighters held in captivity.

Though the board continues to frame its decision and the entire case as a legal issue of punishment for crimes, it is clear that this recent decision is a political one aimed at disheartening our people, weakening our movement and forcing us to submit to the ongoing colonization and domination of the US empire’s will.

It is clear to us that the Parole Board had no intention of seriously considering Dr. Shakur’s release on parole after 30 years. After allowing the prosecutor of the case, as well as family and friends of officers killed in the Nyack New York incident from which the case stems, to testify by Skype, the hearing examiner asked several highly charged political questions such as, “What do you mean when you sign off letters and statements with ‘stiff resistance’?” He then proceeded to answer his own question, “It sounds like you mean stiff resistance against the Government”. The examiner also asked Dr. Shakur, “Why do you think you are a political prisoner?” He than again responded to his own question, “you were convicted of murder and robbery, not political offenses”. Based on these and other questions, the examiner declared that because Dr. Shakur does not take responsibility for his so-called crimes and he ends his letters with “Stiff Resistance” and he continues to claim to be a “political prisoner” he is likely to reoffend if let out into the community.

It is evident with this hearing that the State sees ongoing resistance to colonization and oppression of Black people as a threat. This is why the current strategy of the State is to criminalize resistance! The State is attempting to force Black revolutionaries to denounce the history of resistance and cry “uncle”. This is a similar tactic that the South African government attempted to use on Nelson Mandela and other South African freedom fighters. The American government (the State) wants to eliminate the memory of our historic fight for freedom and self-determination.

It is important that we not allow political repression to silence our voices or frighten us into discontinuing our charges of human rights violations. We must declare to the world that there are Political Prisoners and Prisoners of War being held in US prisons. We must stand and defend our political prisoners and POWs and declare them to the world without submitting to the States intimidation! We have to continue to declare that there are PPs and POWs not only as a result of COINTELPRO but increasingly as the struggle heats up, new political prisoners and prisoners of war are being created as our people are once again taking to the streets. Already several activists from Black Lives Matter are being tried after actions carried out in Los Angeles, St. Louis and Baltimore. The State will not stop its oppression and imprisonment of our people and we cannot stop the fight for our liberation!

In the face of this blatant continued attack on Dr. Mutulu Shakur and our liberation movement, we say STIFF RESISTANCE and STRAIGHT AHEAD! We will not back up one step! We will continue to build a broad based national, and international human rights campaign that educates and exposes the colonial repression of the Empire not only against our nation New Afrika but also against the indigenous First Nations (American Indians) and prisoners like Leonard Peltier and the Puerto Rican nation and prisoners like Oscar Lopez Rivera. We are all colonized peoples and our freedom lies in telling the world and in moving Straight ahead with Stiff Resistance! Freedom for Dr. Mutulu Shakur and all the political prisoners and POWs of the American Empire!

We call on Black people and all people who love freedom and justice to continue to support the movement to free Dr. Mutulu Shakur and all of our political prisoners and prisoners of war. Continue to declare Mutulu is welcome here. Spread his name and image so that the world knows about Mutulu and about our struggle for human rights and self-determination. We call on artists to create cultural expression to educate the people about Mutulu. Write letters, sign petitions and organize actions in your local areas to educate the people and to encourage the people to take a stand for Mutulu’s freedom and for the liberation of Black people! Stiff resistance is a human right. Like Malcolm we declare that we will have our human rights “by any means necessary”.

Take Action: Demand the PA free five imprisoned Palestinian activists subject to torture!

Five Palestinian young men, Basil al-Araj, 33; Mohammed Harb, 23; Haitham Siyaj, 19; Mohammed al-Salamen, 19; and Ali Dar al-Sheikh, 22, are currently imprisoned by the Palestinian Authority; their detention was extended on Monday, 11 April for 15 more days by the PA’s Magistrate’s Court for them to undergo further interrogation. The story of their discovery, arrest and imprisonment has been widely reported in Palestinian media; several of the young men are well-known community and civil activists. Click here to take action and demand the immediate release of these young Palestinians.

Addameer Prisoner Support and Human Rights Association reported on 11 April that their lawyer confirmed that the five Palestinians were being subjected to sleep deprivation, stress positions, lengthy interrogations, physical hitting and beating, insults and denial of access to the toilet; all of this was reported to the Addameer lawyer during the hearing for the extension of their detention.

Al-Araj, Harb and Siyaj were arrested on Saturday night, walking near Ramallah, while al-Salamen and Dar al-Sheikh were arrested a week before. Ma’an News noted that “according to the Israeli media report, the three were detained thanks to ‘cooperation between Israel and the Palestinian Authority.'”

Addameer wrote, “Addameer considers the actions of the Palestinian Security Forces to be in contravention with the International Covenant on Civil and Political Rights (ICCPR) as well as the Convention Against Torture (CAT), both of which the Palestinian Authority is a party. These treaties prohibit the use of torture and ill-treatment against detainees and affirm the right of individuals to fair trial guarantees. Addameer condemns the use of torture and ill-treatment under any circumstances and considers this to be a non-derogable norm, to which individuals must be held accountable. Addameer holds that the Palestinian Authority must comply with the conventions to which it is a party, especially considering the ongoing deteriorating human rights situation in the occupied territories.”

The context of these arrests is that of ongoing PA security coordination with the Israeli occupation. These young men are not a threat to Palestinian security; they are well-known, beloved members of their community and trusted strugglers for the freedom of the Palestinian people. They are not being detained and tortured to protect the Palestinian people, but because the Palestinian Authority, under the Oslo Accords, is a subcontractor of arrests, surveillance and imprisonment to the Israeli occupation that is daily killing Palestinians, imprisoning thousands, carrying out home demolitions, land confiscation, settlement building, racist repression and preventing millions of Palestinian refugees from returning home.

Samidoun Palestinian Prisoner Solidarity Network urges people of conscience around the world to take action and demand that the PA release these five young men and hold accountable those who have tortured and abused them. It is critically important for international supporters of the Palestinian people and Palestinian cause and Palestinians around the world to make their voices heard and demand an end to the arrest and torture of these young men and the policy of security coordination which has brought about this situation.

Days of Action for Omar Nayef Zayed: Report on international events and actions

The Global Days of Action for Justice for Omar Nayef Zayed saw events, actions, and memorials take place across Europe and the United States, urging justice, transparency and full accountability for the death of the former Palestinian prisoner whose body was found in the Palestinian Embassy in Sofia, Bulgaria on 26 February. Nayef Zayed, 52, had lived in Bulgaria for 22 years, and was married with three children and active in the Palestinian community. He fled to Bulgaria after escaping Israeli imprisonment after a 40-day hunger strike in 1990. He had been imprisoned as a struggler in the Popular Front for the Liberation of Palestine, accused by Israeli occupation courts of participating in an armed Palestinian resistance action in which an extremist settler in occupied east Jerusalem was killed.

In December 2015, the Israeli state requested that the Bulgarian government arrest and extradite Omar for re-imprisonment in Palestine; with the support of an international campaign, he was taking refuge in the embassy and working on a legal and political defense against extradition on the basis of an unfair trial and unjust conviction by an illegitimate occupation. While in the embassy, he faced constant pressure from Ambassador Ahmad al-Madhbouh and related Palestinian Authority representatives to leave the embassy quickly. His body was found on 26 February, having fallen from a high floor of the embassy. The Bulgarian police and Palestinian investigating commission have announced no results from his autopsy, forensic examinations or the ongoing criminal investigations.

Last week marked the 40th day after Nayef Zayed’s death, a time for commemoration of his life and continuing demands for justice in his case. In response to a Palestinian call to action for 8-9 March, events took place in New York City, Sofia, Hamburg, Berlin, Wuppertal, Copenhagen, and Gaza City urging justice in Nayef Zayed’s case.

Gaza City

gaza-nayef12Nayef Zayed’s comrades took to the streets in Gaza City, Palestine on Tuesday, 12 March, for a march and rally commemorating his life and demanding justice in his case; Palestinians carried a mock coffin for Nayef Zayed and demanded accountability from al-Madhbouh and PA Foreign Minister Riyad al-Malki. Linking the death of Nayef Zayed to the PA’s practice of security coordination with the Israeli occupation inside Palestine,  participants demanded real accountability from Palestinian officials on Nayef Zayed’s case.

Copenhagen

denmark1In Copenhagen, Denmark, members of the Internationalt Forum/Middle East Group presented a letter and statement to the Bulgarian Embassy in Denmark  on Friday, 8 April, urging action on the part of the Bulgarians to hold accountable those responsible for Nayef Zayed’s death. The letter of protest accused the Bulgarian authorities of sharing responsibility for the death of Nayef Zayed. “Internationalt Forum/the Middle East Group protests against the lack of protection of Omar Nayef Zayed. The Bulgarian authorities bear a heavy responsibility for the success of his murderers to enter the embassy and kill Omar,” said the letter.

Wuppertal

leila-wupp1In Wuppertal, Germany, the Coordinating Committee of Palestinian Associations and Institutions organized an event marking Land Day as well as Palestinian Prisoners’ Day on Saturday, 9 April. Keynote speakers Leila Khaled and Abdel-Bari Atwan demanded justice for Omar Nayef Zayed, while former prisoner Naim Mattar delivered a speech on behalf of current and former prisoners, demanding action on the case. Posters of Nayef Zayed adorned the packed hall for the event, which concluded with a performance by the Al-Karmel Folkloric Dance Troupe.

Berlin

omar-berlin3In Berlin, Germany, the Democratic Palestine Committees convened a memorial event and a call for justice in Nayef Zayed’s case on Sunday, 10 April. With the participation of a broad array of Palestinian organizations and political groups, speakers and participants in Berlin recalled Omar’s life, his experience in struggle and inside Israeli prisons, and his work in the Palestinian community in Bulgaria. They expressed their anger at the injustice of his death and demanded that those responsible be exposed and held accountable internationally.

Hamburg

omar-hamburg4The Democratic Palestine Committees in Hamburg, Germany, protested on Friday, 8 April outside the Bulgarian consulate in the city, carrying banners telling the story of Omar’s life and death and Palestinian flags. Speakers called for justice and accountability for Nayef Zayed and distributed information on the Palestinian struggle and the situation of Palestinian political prisoners.

New York City

NYC_8Apr_OmarNayefZayed7Demonstrators in New York City called for justice for Omar Nayef Zayed on Friday, 8 April. Part of the ongoing weekly protests for freedom and justice for Palestinian political prisoners organized by Samidoun Palestinian Prisoner Solidarity Network in New York City, the demonstration began outside the Bulgarian consulate. Participants carried Palestinian flags and signs demanding justice and accountability in the death of Nayef Zayed, and an immediate transparent and independent investigation into the case. Participants then marched to the Palestinian mission to the UN, where the demonstration continued, calling for justice in Palestine and for Nayef Zayed.

Sofia

sofia8apr-1With the participation of Nayef Zayed’s family,  the Palestinian Community in Bulgaria protested outside the Palestinian embassy in Sofia on Friday 8 April, demanding the dismissal of Foreign Minister Riyad al-Malki, and Palestinian ambassador Ahmad al-Madhbouh, as well as the summoning of Madhbouh and other security staff at the embassy for direct questioning and investigation in their role in Nayef Zayed’s death. The demonstration on 8 April followed one three days prior, outside the office of the Bulgarian President in Sofia Community members delivered two letters, to the President and Prime Minister of Bulgaria, calling for intensified investigations and the release of the forensic report and autopsy results in martyr Nayef Zayed’s case.

Palestinian prisoner Eyad Fawaghra on hunger strike for 30 days; demanding family visits

eyad-fawaghraThe Palestinian Prisoners’ Affairs Commission reported on Monday, 11 April that Eyad Fawaghra has been on hunger strike for 30 days. His hunger strike had not been previously reported and he joins several other Palestinian prisoners engaged in open hunger strikes against administrative detention, isolation and repression within Israeli prisons.

Fawaghra, from Bethlehem, is on hunger strike to protest the denial of family visits, specifically visits from his mother and brother. He is refusing to take vitamins or supplements, and Eshel prison is withholding migraine pain medication if he refuses to consume food. His clothing and blankets have also been confiscated by the prison administration, reported the commission.

He joins several other prisoners engaged in hunger strikes, including Sami Janazrah, 43, a Palestinian refugee from Al-Fuwwar camp near al-Khalil, who has been on hunger strike for over 40 days, since 3 March; Adib Mafarja, from Beit Laqiya near Ramallah, who has been on hunger strike for 11 days, and Fuad Assi, who has also been on hunger strike for 11 days. All are demanding an end to their administrative detention without charge or trial. Janazrah, Assi and Mafarja are being held in solitary confinement – Janazrah Assi in the Naqab prison and Mafarja in Beersheba.

Shukri Khawaja also launched a hunger strike on Sunday, 10 April, demanding an end to his solitary confinement. 15 prisoners in Ofer prison returned their meals on Monday, 11 April and Tuesday, 12 April, in solidarity with Khawaja, who has been held in isolation for over 16 months. 10 prisoners in Eshel prison and 10 more from Nafha prison also returned their meals on Tuesday, 12 April in support of Khawaja; Palestinian prisoners affiliated with Hamas throughout the prisons have stated they will launch an open hunger strike if Khawaja is not returned to general population.

European parliamentarians urge release, EU action on case of Khalida Jarrar

23 Members of European Parliament directed a letter today, 12 April, to Federica Mogherini, High Representative of the European Union for Foreign Affairs, expressing their “great concern with the arrest, detention and sentencing of the Palestinian Legislative Council member Khalida Jarrar.” Jarrar, a prominent Palestinian leftist, feminist and advocate for political prisoners, is serving a 15-month term in Israeli prison; she was arrested on 2 April 2015.

The MEPs called on Mogherini to raise Jarrar’s case with the Israeli government and demand her immediate release, that the issue of Palestinian political prisoners is raised and investigated, and that the EU mission in Israel and future EU delegations visit Jarrar and fellow Palestinian prisoners.

Further, they raised the overall situation of Israeli military courts, which convict Palestinians at a rate of over 99%, the transfer of Palestinian prisoners inside Israel, and new legislation threating heavy sentences for children and stone-throwers, as well as the legislation allowing force-feeding of hunger strikers.

The letter, signed by members of the Socialists & Democrats (S&D), European United Left/Nordic Green Left (GUE/NGL), Alliance of Liberals and Democrats for Europe (ALDE), Greens/European Free Alliance (Greens/EFA), and Europe for Freedom and Direct Democracy (EFDD) groups in the Parliament, highlighted the injustice of Israeli military courts and the nature of “prohibited organization” charges which deny Palestinian freedom of association and criminalize Palestinian politics. The letter discussed the nature of the charges against Jarrar, which focused on public political activity and speeches, and the use of alleged secret evidence to jail Jarrar and deny her bail.
